The State or Arizona Versus Darcy Dale Hurley

In searching for pen pal ads for Darcy Dale Hurley I stumbled across this legal document that appears to be where Darcy Hurley appealed his sentence back in 1987. Among other things, this sheds a really bright light on what Darcy Dale Hurley did to land himself in prison for this long. I always knew Darcy Hurley was in prison due to armed robbery because it was stated on his prison record. However, Darcy has always claimed his sentence was unjustly long for what he did. And on the surface, I often wondered the same thing. Why did they give Darcy Hurley such a long sentence when murderers often even get less time. This document shows that Darcy Hurley committed these armed robberies while we was on parole from some prior offense which I am not aware of. In other words: Darcy Dale Hurley was a career criminal and they threw 3 life sentences at him.

On the evening of February 26, 1985, Hurley and an accomplice, William Alford Elliott, robbed three separate groups of people in east Phoenix hotel parking lots. Shortly before 8:00 p.m., the two men robbed an elderly couple. Brandishing a handgun, Hurley took the man’s wallet, the woman’s purse and jewelry, and then ordered the two to lie face-down between two vehicles on the asphalt as he and Elliott left. During the next hour, Hurley and Elliott robbed two businessmen as they were leaving their car. Hurley twice used the gun to strike one of the men in the face. After 9:00 p.m., Hurley, unaccompanied, robbed a different group of three men. Shortly following the third robbery, the police arrested Hurley and Elliott.

The state then introduced certified copies of official documents showing that Hurley had prior convictions for endangerment, burglary, and escape and was on “mandatory release”4 status from the Arizona Department of Corrections (DOC) when he committed the robberies. In addition, a parole officer testified that Hurley was to be on mandatory release status until June 20, 1985.

This also indicates that Darcy was acting as his own defense in this proceeding. Haha. Good one.

Hurley has alleged a potpourri of federal constitutional violations. First, he contends that as interpreted by this court, § 13-604.02(A) violates the due process and equal protection clauses of the fourteenth amendment, the eighth amendment prohibition against cruel and unusual punishment, and the jury trial guarantee of the sixth amendment. In addition, he claims that the manner in which the sentencing statute and other criminal statutes were applied to him created an unconstitutionally excessive sentence. We address these issues in turn.

Update 10-15-2011

Well not much to add.  Guess who is STILL in prison 3 years after he was supposed to magically be getting out.  That was August 2008.  This is October 2011 and there is no sign of him getting out of prison.  Also I updated his prison record link. The old one was out of date but this one takes you their newest page on him.  I also deleted his prisoner ad at ‘Write a Prisoner”.  He doesn’t seem to be advertising there.  If I find another ad he has placed, I will post a link.

Well Well Look who is Still in Prison

It’s late into March of 2011 and look who still is in prison! Why it’s Darcy Dale Hurley. More than 2 years after he was supposedly “getting out”. Almost 3 years since his dubious August, 2008 release date. Not only is this scammer still in prison, but he is still in the process of racking up negative disciplinary actions in his record. He has graduated from the simple “disobeying orders” to the more criminally natured ones like Tampering with Security (9/7/2010 and again on 2/3/2011) and “Positive or Refusal” on 12/29/2010. I had to think about that last one for a minute but it likely means he tested positive for some controlled illegal substance or refused to take a drug test. Business as usual for Darcy Hurley!

One thing that is different is his location. He is now in the Stiner Unit whatever that means. He was in Eyman and moved to Lewis at some point which I missed. Now he appears to have change units in Lewis. Scammer Darcy Hurley must be a real work if they won’t even let him out on time. Most prison systems are struggling to fund their operations and that means they have to not hold anyone longer than they have to. Each inmate costs money. So the fact they continue to hold Darcy Hurley is proof of what a hopeless case he is.

Darcy Hurley’s Personal Ad Removed

Also interesting is that his personal ad (linked on the right) has been removed. It still shows the phony photo of someone that isn’t Darcy Hurley. A commenter named Chris had this to say about Darcy Hurley phony photo (see 5/17/09):

Thanks for putting the information out there on Darcy. I actually saw him at SMU-1 (Special Management Unit) while visiting another inmate. The visits are all behind glass, and he was at one of the other visiting areas behind me, when my friend told me it was him. He does look like his photo — a really “worn” or “worn out” look to him. It was then that my friend told me Darcy had used a fake photo in his posting. The photo was actually a relative of my friend.

In other words, Darcy just swiped the photo from another inmate and used it. Unfortunately for that person, the photo has never been updated and still seems to be attached to Darcy Hurley’s prison pen pal ad. In all likelihood, Darcy Hurley ran out of money and could not pay for the ad. Hopefully, this blog is helping to get the word out that he is a scam artist and should not be given money.

Darcy Hurley Kitchen Cook

Well it looks like prison pen pal scam artist Darcy Hurley is still in prison even though he was supposed to get out in the summer of 2008. Hmm. And the scam business must not be supplying him with enough suckers to give him money because it looks like he’s slaving away in the kitchen. According to his most recent prison record under “Work Programs” he was a Kitchen Cook in October. I can’t tell how that panned out. Knowing Darcy Dale Hurley, he probably got into a fight and got dismissed.

He also has two disciplinary notes this year – both in recent months. “Tampering with Security” on 9/7 and “Disobey Verbal” on 9/22. That’s Darcy Hurley! Always getting in trouble. I am watching for his parole or release and am still not seeing it on record. The most recent entry in “Parole Placement” was on 11/3/10 and does not tell me much. He is still listed as an “inmate” and “active”. If he’s in the kitchen cooking, heaven help the people who have to eat what he has prepared.

Darcy Hurly is on the Move

It’s been a while since I’ve written about prison pen pal scam artist Darcy Hurley. But according to his record, it looks like he’s on the move again. As of today (10/12/2010) his prison record lists his location as “ASPC Lewis Transitory Unit”. I can’t find any specific information on the ASPC web site as to what “Transitory” might mean. His last movement was 10/5/2010 so Darcy Dale Hurley is either on his way to yet another facility or he is on his way out. His next review date is 12/11/2010 so I doubt he is getting out yet. Pretty interesting that the scammer is still behind bars when he was supposed to get out in the summer of 2008. That brings up a point. Always go by what the prison record shows. If you are corresponding with an inmate and he tells you something different, then he’s probably lying. Like Darcy Hurley – liar liar pants on fire. He still sits in his cell trying to scam other people. I hope this blog has put an end to his scamming and lying.

Darcy Hurley still in Denial

I got a letter from Darcy Hurley the other day. Amazing. I had sent him a post card a month ago saying it was still OK to write to me; but to just please drop the charade of needing money to get out. And what does he do? Spends half the letter still in denial about his lying to me. He still makes reference to that preposterous claim about being left in prison because of having no exit money. He tells me in the letter that we should be move on and not focus on the past and all that blather. I will write him back and will make no mention of it UNLESS he starts asking for money again.

Among other things he claims the “computer” shows the wrong parole date:

My first parole board is 9-23-2010 and the second is 3-7-2011. The judge investigated and found that under my sentencing statute, he could not reduce my sentence until I’ve served 25 years. 25 years will be 9-23-2010 and I was told I could re-apply and / or the Parole board could give me clemency and let me out….blah blah blah…

Oh now he blames on the judge who once again moved the date. At least here he’s taking the focus off the “I need money to get out” lie. The two dates on the website are 2-25-2010 and 8-9-2010. The later date is more like it since that would be the 25 year mark (the website shows he was admitted on 8/19/85). Anyway Darcy couldn’t resist getting in a few swipes at “Tom” and calling him a liar. He doesn’t know he’s on the internet and other people have come forward to support the fact that Darcy is lying.

Will Darcy Hurley get out Early?

I have another person besides Darcy Hurley I write to in the Arizona Prison System. Unlike Darcy Dale Hurley, this one provides reliable information and has never asked me for any money. I don’t reveal names (expect for that scamming Darcy Hurley) so I will call this one “Tom”. Tom has been the one I have run a lot of Darcy’s stuff by including his preposterous travel money story and his ridiculous transfer form. I can usually count on Tom to give me the straight scoop.

Anyway, Tom tells me there is a piece of legislation headed for the Governor’s desk that will require the state to release about 19,000 prisoners. According to the Bureau of Justice Statistics, Arizona had about 39,000 prisoners in mid 2008 (about 1 year ago). That means they would be releasing nearly half of the prison population! Tom thinks he stands a good chance of being released if this is signed off Governor Brewer. Tom’s earliest release date is mid 2010; very similar to Darcy Hurley’s earliest possible parole date.

The governor’s desk probably has a lot of budget management measures on it right now. I don’t know the story behind this bill and have asked Tom for a bill number. Nor do I know if this will even go through. I know this has to do with fiscal measures and saving money at the state level. However, that still sounds like a lot of prisoners to let loose.

Presumably they will be focusing on low risk prisoners and prisoners whose release time is coming up soon anyway. It’s that second part that makes we wonder if Darcy Hurley will be allowed to fly the coup if this bill passes. His earliest parole date is listed as next February (2010). I will be watching this closely and try to get more information. If anyone has any information on this bill please post it in comments.

Darcy Hurley and his Phony Proof

I forgot to mention that back in January, Darcy Hurley send me “proof” that the only thing holding him in there was no money in his account. His so-called proof was a joke. It was an Arizona Prison Transfer form filled in red pen with handwriting that looked a lot like Darcy Dale Hurley’s! The term “ absolute release” was hand written in. In fact there was a lot of written in phoniness. See for yourself!

Darcys Phony Form

He disguised it a bit but it was pretty easy to see. And another inmate who is also in the Arizona system told me that is not what the form is used for. What a scam. I wrote him back and told him in just a few short words that I didn’t believe him and that form was filled in by him. I have not heard back from Darcy Hurley since. Guess maybe he’s moved on to scamming someone else. Maybe I will drop him a short line about that phony picture!

Darcy Dale Hurley – Even his Photo is Phony!

I have not updated this blog in awhile. Quite frankly, I have more important things to do with my time. But today I came to check the blog and found three things.

1 – The link to his prison record was updated and it didn’t work (Fixed)

2 – There is a newer photo of him on the new updated prison record page (Fixed)

3 – That prior photo of him on my About page wasn’t even him!

That is according to one of the commenters on the About page. And frankly I have no reason to doubt the commenter when it comes to Darcy Hurley. That other photo doesn’t even look like him; even if you allow for the fact that it might be an older photo. The old photo can be viewed on the link titled “Darcy Hurley’s Prisoner Ad”. Unfortunately I have no control over that site but I will see if I can find an email contact there to let them know they have a phony photo. Which leads me to ask again: Is anything real about Darcy Hurley?

Other than the photo and a different URL, there is nothing new on Darcy Dale Hurley’s prisoner record. No sign of pending release, no sign of parole any time before February 2010. Thanks to the commenters and I will make it point to keep updating this blog.
